Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Canvas Eyewear's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Our custom sunglasses configurator is designed to give you the best digital representation of your sunglasses prior to being individually produced to your design specifications. Minimal discrepancies may exist from the image you see on your monitor to the actual pair of custom sunglasses, including color shade and/or placement of design.

Intellectual Property

Canvas Eyewear respects the intellectual property rights of others. By using this website, you represent and warrant that you are the owner of any material including but not limited to text, data, photographs, graphics, stitch files, images, information, and all digital data or any combination of these elements (“Content”) which you submit, and that the content does not infringe upon the property rights, intellectual property rights (copyrights and trademarks), patent, trade secret, right of privacy, right of publicity, or other rights of others. You also represent and warrant that there are no outstanding claims, demands, disputes, or any form of litigation pending, or to the best of your knowledge, threatened with respect to any of your Content. You hereby represent and warrant to us that this agreement has been duly and validly executed and delivered by you and constitutes your legal, valid, and binding obligation, enforceable against you in accordance with its terms; and that the execution, delivery, and performance by you of this agreement are within your legal capacity and power; have been duly authorized by all requisite action on your part; require the approval or consent of no other persons; and neither violate nor constitute a default under the (I) provision of any law, rule, regulation, order, judgment, or decree to which you are subject or which binding upon you, or (II) the terms of any other agreement, document, or instrument applicable to you or binding upon you.

Prohibited Content

You agree to defend, indemnify and hold Canvas Eyewear and Canvas Eyewear's officers, directors, employees, agents and licensors harmless from all judgments, awards, losses, liabilities, costs and expenses, including but not limited to reasonable attorney's fees, expert witness fees, and costs of litigation arising out of or based on (a) Content you submit, post to or transmit through the Site, (b) your use of the Site, (c) your connection to the Site, (d) your violation of the Agreement or (e) your violation of any rights of a third party.

Limitations

In no event shall Canvas Eyewear or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Canvas Eyewear's Internet site, even if Canvas Eyewear or a Canvas Eyewear authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Revisions and Errata

The materials appearing on Canvas Eyewear's website could include technical, typographical, or photographic errors.
